Corporate Mail Hosting Service Terms of Use

I. Description and Terms of Service

In order for METUnic to provide its mail hosting service, the CUSTOMER shall be deemed to have accepted these Mail Hosting Service Terms of Use.
The CUSTOMER agrees, declares, and undertakes that the corporate mail hosting service purchased shall be used for commercial or professional purposes.
The mail hosting service is a service provided by METUnic upon the CUSTOMER’s request, associated with a specific domain name.
Within the scope of the mail hosting service, e-mail addresses created under the domain name designated by the CUSTOMER, as well as the existing and future e-mail contents therein, shall be hosted on servers determined by METUnic and made accessible via the Internet.
The CUSTOMER agrees, declares, and undertakes to comply with all policies and procedures published on www.metunic.com.tr in addition to these Terms of Use. These Terms of Use constitute an annex to the Product and Service Agreement executed between METUnic and the CUSTOMER and shall have binding effect together with the agreement.

II. Responsibilities

  1. METUnic undertakes to use all reasonable resources to ensure reasonable continuity and operability of the service during the term of this service. The CUSTOMER acknowledges that access to the services may be interrupted in certain circumstances, including but not limited to: force majeure, hardware failures, periodic maintenance operations, interruptions in telecommunication infrastructure, malicious attacks, heavy traffic, and other situations beyond METUnic’s control.
  2. The CUSTOMER shall not use the mail hosting service provided by METUnic for purposes such as spam, phishing, dissemination of malware, deception by false identity or content, threats, insults, harassment, encouragement of illegal activities, copyright and other intellectual property infringements, or the transmission of content contrary to public order and morality. METUnic is not obliged to monitor the accuracy or legality of the content transmitted within the scope of the service; any and all legal, criminal, and administrative responsibility arising from such content lies solely with the CUSTOMER.
  3. The CUSTOMER agrees to use METUnic services only for lawful and authorized purposes; shall not engage in activities that constitute crimes, violate system security, or overload the service. The CUSTOMER shall not violate system or network security; shall not use false identity information; and shall not misuse the service through methods such as flooding, spamming, or mail bombing. METUnic reserves the right to suspend or terminate the service and to monitor system access where deemed necessary. The CUSTOMER is obliged to provide up-to-date contact information and to respond to notifications in a timely manner.
  4. If the CUSTOMER uses third-party services (such as antivirus or spam filters) within the scope of the service provided by METUnic, METUnic shall not be responsible for any issues arising therefrom. Furthermore, data, content, and e-mails stored or transmitted on the server by the CUSTOMER must comply with the laws of the Republic of Turkey, public order, and morality; and must not infringe the intellectual and industrial property rights or personal data of third parties. All liabilities arising from such content rest solely with the CUSTOMER.
  5. METUnic may review service records and share necessary information and documents solely with competent official authorities in response to lawful requests. The CUSTOMER cannot impose any liability on METUnic for these actions.
  6. The CUSTOMER undertakes to act in compliance with Law No. 5651 and related legislation, to provide necessary information in a timely manner upon official request, and accepts that all liability arising from unlawful content rests with itself. In this context, METUnic reserves the right to suspend or terminate the service. The CUSTOMER cannot claim any rights or compensation from METUnic in such cases.
  7. In the event of violations of the usage rules defined under this agreement by the CUSTOMER or its own users, METUnic has the right to suspend, terminate, or apply both measures simultaneously against the relevant users’ services. In such cases, METUnic shall bear no liability for users who are deactivated. The CUSTOMER agrees to indemnify METUnic, its managers, employees, and affiliates against any damages arising from such violations.
  8. In case of commercial use, the CUSTOMER must ensure that its users publish a valid privacy policy in accordance with applicable law; obtain consent from recipients through a legally compliant method for sending advertising and commercial e-mails; be able to prove such consent within seventy-two (72) hours upon request by METUnic or the relevant recipient; take reasonable technical measures to ensure that the consenting person is the owner of the e-mail address concerned; and, in case of withdrawal of consent, notify the recipients accordingly and remove them from the contact list.
  9. Due to the dynamic nature of the internet, METUnic may update the terms of this agreement from time to time. METUnic shall notify the CUSTOMER of such changes within a reasonable time. The CUSTOMER is responsible for reflecting such changes to its users and ensuring compliance.
  10. The CUSTOMER shall not resell, license, sublicense, or transfer the software to third parties.
  11. If the CUSTOMER does not request renewal or fails to complete the necessary procedures, METUnic shall not be responsible for the termination of the service.
  12. The Parties undertake to refrain from acts that may harm each other’s commercial reputation and prestige.

III. Fees and Payment

  1. The service shall be defined on an annual basis and its fee shall be collected in advance on an annual basis during the order stage.
  2. Before the service period expires, METUnic shall send routine reminders to the CUSTOMER. It is the CUSTOMER’S responsibility to initiate the renewal process.
  3. Services that are not renewed before the expiration of the service period shall be suspended. Deleted services cannot be recovered, restored, or backed up.
  4. Since the service is associated with a domain name, the usability of the service depends on the domain being active. In cases where the domain is inactive, the service shall be interrupted, and the responsibility shall rest with the CUSTOMER.
  5. If the CUSTOMER fails to fulfill its payment obligations on time, the service may be suspended, stopped, or terminated, and METUnic shall not be held liable for any data loss or other damages arising therefrom. Payment tracking is the responsibility of the CUSTOMER.
  6. The CUSTOMER accepts, declares, and undertakes that, upon termination of the service, all data shall be permanently deleted; this process is irreversible, and no rights or claims for compensation shall be made against METUnic arising from such deletion.

V. Cancellation, Refund and Withdrawal from Agreement

Before invoicing, either Party has the right to withdraw from the agreement.
In case one of the Parties withdraws from the agreement due to one of the reasons listed below, the payment made by the CUSTOMER shall be refunded, and in such case, the Parties agree, declare, and undertake not to claim any rights or receivables from each other under any name whatsoever:

  • If, for any factual or technical reason, the service cannot be activated within 3-7 business days
    days;
  • If the service does not technically function through no fault of the CUSTOMER, as
    confirmed by an inspection conducted by METUnic’s technical team;
  • If the service cannot be provided due to legal or regulatory restrictions.

The CUSTOMER has the right to cancel the service. The cancellation process is carried out through the “Cancel” option available in the CUSTOMER panel. During the cancellation request, the CUSTOMER shall be asked to specify the reason for cancellation.
Following the submission of the cancellation request, a support ticket shall automatically be created by the system, and the request shall be processed. Upon the approval of the Operations team, the service shall be cancelled.
If the CUSTOMER is entitled to a refund, it is mandatory to issue a refund invoice or send the e-archive invoice with wet signature via cargo to the METUnic, clearly stating the refund amount, based on the invoice provided to the CUSTOMER. If these conditions are not met, the refund cannot be processed.

These Terms of Use constitute an annex to the Product and Service Agreement executed between METUnic and the CUSTOMER and shall have binding effect together with the agreement.

VI. Service Capacity, Limits, and Usage Policies

  1. The CUSTOMER acknowledges that the purchased corporate e-mail service is subject to the following technical capacities, limits, and policies. These rules are determined to ensure that the service is provided in a fair, stable, and secure manner for all users.
  2. Mailbox Capacity: Each mailbox can store up to 200,000 e-mails.
  3. E-mail Size: The total size of sent or received e-mails, including attachments, cannot exceed 30 MB.
  4. Attachment Size: Files directly attached to e-mails are limited to 25 MB. However, attachments up to 1 GB can be sent using the platform’s supported “Drive Mail” feature.
  5. E-mail Aliases: A maximum of 50 aliases can be created per mailbox.
  6. Forwarding Rules: A maximum of 4 forwarding rules can be defined per mailbox.
  7. Recovery of Deleted E-mails: E-mails deleted through the user interface can be recovered within 14 days of deletion. After this period, deleted items cannot be accessed.
  8. IMAP Connection Count: To maintain service stability, a maximum of 30 simultaneous IMAP connections can be made per mailbox from a single IP address.
  9. Calendar, Contacts, and Tasks: Each user account may create up to 250,000 records(appointments, contact cards, tasks, etc.) within each of the Calendar, Contacts, and Tasks modules.

VII. Bulk E-mail Policy

In addition to the above limits, this service is designed specifically for one-to-one corporate communication and cannot be used for bulk e-mailing (mass mailing) or as an e-mail marketing tool. In order to prevent misuse of the service and activities that may be considered spam, the platform includes security mechanisms such as ‘rate limiting’, which automatically restricts the sending speed upon detecting abnormal usage patterns such as sending large numbers of e-mails in a short period. Such usage shall be deemed misuse of the service as specified in the ‘Responsibilities’ section of the agreement and shall entitle METUnic to suspend or terminate the service. CUSTOMERS who require bulk e-mail sending must contact us to obtain information about our separate services offered for this purpose.
