I. Description and Terms of Service

In order for METUnic to provide its mail hosting service, the CUSTOMER shall be deemed to have accepted these Mail Hosting Service Terms of Use.
The CUSTOMER agrees, declares, and undertakes that the corporate mail hosting service purchased shall be used for commercial or professional purposes.
The mail hosting service is a service provided by METUnic upon the CUSTOMER’s request, associated with a specific domain name.
Within the scope of the mail hosting service, e-mail addresses created under the domain name designated by the CUSTOMER, as well as the existing and future e-mail contents therein, shall be hosted on servers determined by METUnic and made accessible via the internet.
The CUSTOMER agrees, declares, and undertakes to comply with all policies and procedures published on www.metunic.com.tr in addition to these Terms of Use.
These Terms of Use constitute an annex to the Product and Service Agreement executed between METUnic and the CUSTOMER and shall have a binding effect together with the agreement.

II. Responsibilities

  1. METUnic undertakes to use all reasonable resources to ensure the reasonable continuity and
    operability of the service throughout the service period. The CUSTOMER accepts that access to the services may be interrupted under certain circumstances, including but not limited to force majeure events, hardware failures, periodic maintenance, interruptions in telecommunications infrastructure, malicious attacks, high traffic, and other situations beyond METUnic’s control.
  2. The CUSTOMER may not use the mail hosting service provided by METUnic for the purposes of sending spam, phishing, malicious software, deceptive content or false identity, threats, insults, harassment, incitement to illegal activities, infringement of copyright or other intellectual property rights, or content contrary to public order and general morality. METUnic is not responsible for verifying the accuracy or legal compliance of the content transmitted through the service; all legal, administrative, and criminal liability arising from such content belongs solely to the CUSTOMER.
  3. The CUSTOMER agrees to use the mail hosting service only within lawful, secure, and reasonable usage limits. Bulk, automated, or unauthorized commercial email transmissions; spam; malicious software; or phishing emails shall be deemed misuse. The CUSTOMER undertakes not to engage in such misuse and to comply with all applicable communication regulations. METUnic reserves the right to impose sanctions should any misuse occur.
  4. The CUSTOMER agrees to use METUnic services solely for lawful and permitted purposes and not to engage in activities that constitute a crime, compromise system security, or impose excessive load on the service. The CUSTOMER shall not violate system or network security; shall not use false identity information; and shall not misuse the service through methods such as flood, spam, or mail-bombing. METUnic reserves the right to suspend, terminate, or monitor system access when deemed necessary. The CUSTOMER is responsible for providing up-to-date contact information and responding to notifications in a timely manner.
  5. If the CUSTOMER uses third-party services (such as antivirus or spam filtering) within the scope of the service, METUnic shall not be liable for any issues arising therefrom. Additionally, all data, content, and emails stored or transmitted on the server by the CUSTOMER must comply with Turkish law, public order, and general morality, and must not infringe the intellectual property or personal data rights of third parties. All liability arising from such content rests solely with the CUSTOMER.
  6. METUnic may review service-related records and share necessary information solely with the relevant authorities in response to lawful requests from authorized governmental bodies. METUnic reserves the right to suspend or terminate the service or review the records pursuant to decisions or notifications from authorized institutions (such as BTK, ICANN) or administrative authorities (such as courts or law enforcement). As a result of such actions, the CUSTOMER may lose access to the service, including access to the panel and email data. Access may only be restored upon receipt of an order from the relevant authority. The CUSTOMER may not hold METUnic liable for these actions.
  7. The CUSTOMER is solely responsible for account security, including keeping passwords confidential, complying with strong password policies, and preventing unauthorized access by third parties.
  8. The CUSTOMER agrees to comply with Law No. 5651 and other applicable regulations, to provide necessary information upon official request, and acknowledges that all liability arising from unlawful content rests with the CUSTOMER. METUnic reserves the right to suspend, pause, or terminate the service under this scope. The CUSTOMER may not claim any compensation from METUnic in such cases.
  9. In the event that the CUSTOMER or its users violate the usage rules defined in this agreement, METUnic reserves the right to suspend, terminate, or apply both actions to the relevant accounts. METUnic shall not be held liable for any consequences arising from users being excluded from the service. The CUSTOMER agrees to indemnify METUnic, its managers, employees, and affiliates for any damages arising from such violations.
  10. In cases of commercial use, the CUSTOMER must ensure that its users publish a valid privacy policy as required by applicable law; obtain consent from recipients for advertising and commercial emails; provide proof of such consent within seventy-two (72) hours upon request from METUnic or the recipient; implement reasonable technical measures to verify that the consenting party is the legitimate owner of the relevant email address; and ensure that recipients withdrawing their consent are promptly removed from mailing lists.
  11. Due to the dynamic nature of the internet, METUnic may update the terms of this agreement from time to time. METUnic will notify the CUSTOMER within a reasonable period. The CUSTOMER is responsible for reflecting these changes to its users and ensuring compliance.
  12. The CUSTOMER may not resell, license, sublicense, or transfer the software or service to third parties.
  13. METUnic shall not be responsible for the termination of the service if the CUSTOMER fails to request renewal or complete the necessary renewal actions.
  14. Both parties agree to refrain from any conduct that may harm each other’s commercial reputation or standing.
  15. METUnic may collaborate with service partners located outside Türkiye in order to provide the corporate mail hosting service. As the service is strictly corporate in nature and not intended for personal use, any cross-border data processing or transfer that may arise within this scope shall be under the sole responsibility of the CUSTOMER.
  16. The servers, infrastructure, and security components used within the scope of the service may be located in domestic or international data centers. Such configurations arise from the technical requirements of the service and shall be deemed accepted by the CUSTOMER.

III. Fees and Payment

  1. The service term shall be defined as twelve (12) months, and the annual fee shall be collected in advance during the order stage.
  2. Since the service is associated with the domain name, its availability depends on the domain remaining active. In cases where the domain becomes inactive, the service may be interrupted, and the CUSTOMER shall bear full responsibility.
  3. Before the service term expires, METUnic shall send routine renewal reminders to the CUSTOMER. It is the CUSTOMER’S responsibility to initiate the renewal process and to ensure timely payment.
  4. Services that are not renewed before the end of the service term shall be suspended.
    Suspended services cannot be accessed by the CUSTOMER; access to the control panel and email data shall be temporarily disabled. Access to suspended services shall be restored only after successful payment of the renewal fee.
  5. If the renewal process is not completed within fifteen (15) days following the suspension date, all data associated with the service shall be irreversibly deleted by the system. Once deleted, such data cannot be recovered, restored, or backed up.
  6. The CUSTOMER agrees, declares, and undertakes that in case of a payment delay or failure, the service may be suspended or terminated, and METUnic shall not be held liable for any data loss or other damages arising therefrom.
  7. The CUSTOMER acknowledges and agrees that if the service is not renewed and the fifteen (15) day renewal period expires, all data related to the service shall be permanently deleted, and the CUSTOMER shall not claim any right, compensation, or demand in connection with such deletion.

IV. Activation

The activation process of the service begins with the CUSTOMER completing the purchase transaction, successfully making the payment, and accurately entering the order information (such as the ordered package, domain name information associated with the e-mail, etc.). The CUSTOMER must make the payment successfully, completely, and on time in order for activation to occur. Once the payment process is completed, the service is created. Services that are successfully installed become available for use. METUnic shall not be responsible for disruptions or installation failures arising from delays or deficiencies in the order, payment, or installation process.

V. Cancellation, Refund and Withdrawal from Agreement

Before invoicing, either Party has the right to withdraw from the agreement.
In case one of the Parties withdraws from the agreement due to one of the reasons listed below, the payment made by the CUSTOMER shall be refunded, and in such case, the Parties agree, declare, and undertake not to claim any rights or receivables from each other under any name whatsoever:

  • If, for any factual or technical reason, the service cannot be activated within 3-7 business days
    days;
  • If the service does not technically function through no fault of the CUSTOMER, as
    confirmed by an inspection conducted by METUnic’s technical team;
  • If the service cannot be provided due to legal or regulatory restrictions.

The CUSTOMER has the right to cancel the service. The cancellation process is carried out through the “Cancel” option available in the CUSTOMER panel. During the cancellation request, the CUSTOMER shall be asked to specify the reason for cancellation.
Following the submission of the cancellation request, a support ticket shall automatically be created by the system, and the request shall be processed. Upon the approval of the Operations team, the service shall be cancelled.
If the CUSTOMER is entitled to a refund, it is mandatory to issue a refund invoice or send the e-archive invoice with wet signature via cargo to the METUnic, clearly stating the refund amount, based on the invoice provided to the CUSTOMER. If these conditions are not met, the refund cannot be processed.

These Terms of Use constitute an annex to the Product and Service Agreement executed between METUnic and the CUSTOMER and shall have binding effect together with the agreement.

VI. Service Capacity, Limits, and Usage Policies

  1. The CUSTOMER acknowledges that the purchased corporate e-mail service is subject to the following technical capacities, limits, and policies. These rules are determined to ensure that the service is provided in a fair, stable, and secure manner for all users.
  2. Mailbox Capacity: Each mailbox can store up to 200,000 e-mails.
  3. E-mail Size: The total size of sent or received e-mails, including attachments, cannot exceed 30 MB.
  4. Attachment Size: Files directly attached to e-mails are limited to 25 MB. However, attachments up to 1 GB can be sent using the platform’s supported “Drive Mail” feature.
  5. E-mail Aliases: A maximum of 50 aliases can be created per mailbox.
  6. Forwarding Rules: A maximum of 4 forwarding rules can be defined per mailbox.
  7. Recovery of Deleted E-mails: E-mails deleted through the user interface can be recovered within 14 days of deletion. After this period, deleted items cannot be accessed.
  8. IMAP Connection Count: To maintain service stability, a maximum of 30 simultaneous IMAP connections can be made per mailbox from a single IP address.
  9. Calendar, Contacts, and Tasks: Each user account may create up to 250,000 records(appointments, contact cards, tasks, etc.) within each of the Calendar, Contacts, and Tasks modules.

VII. Package Upgrade

  1. An upgrade may be requested for packages that exceed the current capacity or quota. In the event of an upgrade, the service shall be considered newly purchased, and the new package term shall commence for a period of twelve (12) months.
  2. Upon upgrade, the service fee corresponding to the current and remaining months of the previous package shall be refunded. This refund amount shall be deducted from the total fee of the new package, and the remaining balance shall be collected from the CUSTOMER in advance on an annual basis.
  3. Following the upgrade, the service conditions shall be governed exclusively by the new package, and no rights or entitlements arising from the previous package shall carry over to the new term.

VIII. Bulk E-mail Policy

In addition to the above limits, this service is designed specifically for one-to-one corporate communication and cannot be used for bulk e-mailing (mass mailing) or as an e-mail marketing tool. In order to prevent misuse of the service and activities that may be considered spam, the platform includes security mechanisms such as ‘rate limiting’, which automatically restricts the sending speed upon detecting abnormal usage patterns such as sending large numbers of e-mails in a short period. Such usage shall be deemed misuse of the service as specified in the ‘Responsibilities’ section of the agreement and shall entitle METUnic to suspend or terminate the service. CUSTOMERS who require bulk e-mail sending must contact us to obtain information about our separate services offered for this purpose.
