What is a trademark?

A trademark is any sign that can be represented in the registry and that distinguishes the goods or services of one business from those of other businesses, including words, figures, letters, numbers, sounds, and the shape of goods or their packaging.

Who can apply for a trademark?
  • Citizens of the Republic of Türkiye
  • Natural persons or legal entities that reside in, or carry out industrial or commercial activities within, the borders of the Republic of Türkiye
  • Persons entitled to apply under the provisions of the Paris Convention or the Agreement Establishing the World Trade Organization
  • Nationals of states that, under the principle of reciprocity, grant industrial property protection to nationals of the Republic of Türkiye
Should I search for similar trademarks before filing a trademark application?

Before filing a trademark application, a preliminary search should be carried out to determine whether the trademark is eligible for registration.

For the preliminary search, you can use our "trademark registration eligibility search" service, or you can check whether your application is eligible for registration on the website (opens in a new tab) of the Turkish Patent and Trademark Office (TÜRKPATENT).

How is the scope of a trademark application determined?

Before filing a trademark application, it is important to determine the goods and services on which the trademark will be used. A trademark registration is valid only for the goods and services covered by the application, and it grants rights to its owner only for those.

Under the international NICE Classification, goods and services are grouped into 45 classes. Classes 1 to 34 cover goods, while classes 35 to 45 cover services. You should review the classification list carefully before applying.

For more information, you can contact us at marka@metunic.com.tr, and you can access the NICE Classification on the TÜRKPATENT website (opens in a new tab).

What is a legal entity?

A legal entity is an institution, establishment or organization recognized by law. Structures such as joint-stock companies, limited liability companies, associations, foundations and cooperatives have legal personality. If the applicant is a legal entity, the "Legal Entity" option must be selected in the "Trademark Owner Type" section.

What is a natural person?

A natural person is any individual who legally exists from birth until death. If the applicant is a natural person, the "Natural Person" option must be selected in the "Trademark Owner Type" section.

What is a trademark specimen?

It is the sign you want to protect through registration. A trademark specimen can consist of a word, letter or number in a standard font, a logo on its own, or a combination of the two. If the trademark consists only of a word, letter or number in a standard font, simply typing it into the application form is enough. If the trademark contains additional elements such as a distinctive font, logo, color or shape, the trademark specimen must be attached in the relevant section of the application form.

Can the trademark sample be changed after the trademark application is filed?

No changes can be made to the trademark sample after the trademark application has been filed.

Can the trademark registration class be changed after the application is filed?

Once a trademark application has been filed, no changes can be made to the scope or class of the trademark registration.

Can more than one trademark be registered in a single trademark application?

Each application can request registration of only one trademark. If you want to register more than one trademark, a separate application must be filed for each.

I made a typo in my trademark application. What can I do?

Typos in the information in a trademark application can be corrected at the applicant's request, as long as the correction does not change the trademark specimen or the list of goods or services.

Can I use non-Latin characters in my trademark sample?

If characters outside the Latin alphabet are used in the trademark sample, their Latin alphabet equivalents must be provided.

What happens if a registered trademark is not used?

Trademarks that are not used in Türkiye within five (5) years from the registration date, or whose use is suspended for an uninterrupted period, are revoked. However, using the trademark with different elements without changing its distinctive character, or using it on goods or packaging for export purposes, may be accepted as use of the trademark.

Which signs can be registered as a trademark?

Words, figures, letters, numbers, colors, sounds, three-dimensional shapes, motion marks, holograms and, rarely, scents or tastes can be registered as trademarks. Personal names can also be registered as trademarks, provided that they can be represented in the registry in a way that makes the subject matter of protection clearly and precisely understood.

What is the reissue of a trademark registration certificate, and why is it done?

A trademark registration certificate is reissued when the original certificate is lost, worn out or damaged. Upon the trademark owner's application, a new registration certificate with the same content as the original is prepared and delivered; the trademark's protection period does not change. The protection period is ten years from the registration date, and a separate renewal application must be filed at the end of this period. A power of attorney (no notarization required) must be submitted for this process.

What is a full / partial assignment?

A trademark assignment is when the trademark owner transfers the trademark right, fully or partially, to another person or organization. This requires submitting a power of attorney (not notarized) and an assignment agreement.

What is trademark renewal?

The protection period of a registered trademark is 10 years from the application date and can be renewed for successive ten-year periods. The renewal request must be made within the six months before the protection period ends, and proof that the renewal fee has been paid must be submitted to the Office within the same period. A power of attorney (without notarization) must be submitted for the renewal.

What is the renewal of a trademark whose protection period has expired?

The protection period of trademarks that are not renewed on time expires. A renewal request can still be made within 6 months of the date the protection period ended, provided that an additional fee is paid; this is called the renewal of a trademark whose protection period has expired. Trademarks that are not renewed within this six-month period are considered invalid. A power of attorney (without notarization) must be submitted for this process.

What is a trademark company type / trade name change?

This is done when the company's trade name or company type changes from what it was when the trademark was registered. For this process, a power of attorney (without notarization) and a copy of the Turkish Trade Registry Gazette showing the company type/trade name change must be submitted.

What is a trademark address change?

If the address provided at the time of trademark registration changes, the change must be reported to the Turkish Patent and Trademark Office (TÜRKPATENT). Otherwise, all notices and official notifications about your trademark will be sent to your old address. For this process, a power of attorney (no notarization required) and the Turkish Trade Registry Gazette must be submitted.

What is an appeal against the Office's decisions?

If the Turkish Patent and Trademark Office (TÜRKPATENT) issues a decision against you during your trademark's registration process or in the event of its cancellation, you must appeal the Office's decision for the registration to continue. The appeal must be filed within 2 months of the notification date. For the appeal, a power of attorney and, where necessary, documents proving actual ownership of the rights and use of the trademark may be requested.

What is an opposition to a trademark bulletin publication?

Trademark applications approved by the Turkish Patent and Trademark Office (TÜRKPATENT) are published in the Official Trademark Bulletin for two (2) months. During this period, existing trademark owners can file an opposition against applications that are similar to their own trademarks; if the opposition is upheld, the trademark in question may be partially or fully rejected. When filing an opposition, a power of attorney and, where necessary, documents proving actual ownership of the rights and documents showing use of the trademark may be requested.

What is license registration?

License registration is carried out to grant the right to use a registered trademark, or one in the registration process, to other persons or companies for a specific period and fee without transferring ownership. To protect the rights of both parties, the terms of use must be set out in a license agreement and recorded in the registry of the Turkish Patent and Trademark Office (TÜRKPATENT). A power of attorney (no notarization required) must be submitted for this process.

How does the trademark registration process work?

Your trademark application is filed within 1 day. The examination and evaluation process may vary for each trademark; however, trademark registration generally takes 4-6 months from the application date. Applications with a positive evaluation are published in the Official Trademark Bulletin and are registered if no opposition is filed during the two (2) month publication period.

Is a trademark registered in Türkiye also valid abroad?

Trademarks are valid only within the borders of the country where they are registered. Trademarks registered in Türkiye are valid only in Türkiye; for protection abroad, you need to apply in the relevant countries as well. For more information, you can write to marka@metunic.com.tr.

What should I keep in mind when renewing a trademark?

The renewal request must be made within the six (6) months before the protection period ends; otherwise, the protection period expires. An expired trademark can still be renewed within six (6) months of the expiry date, provided that an additional fee is paid. Renewal can also be requested for only some of the goods or services covered by the registration. To renew a collective trademark, it is enough for one of the businesses in the group to submit the requested document.

How long does trademark protection last?

The protection period of a registered trademark is ten (10) years from the application date. When this period ends, it can be renewed for successive ten-year periods.

Is there a difference between individual and company trademark applications?

The "Trademark Owner Type" differs between applications filed by individuals and by companies. For applications filed by individuals, you need to select "Natural Person", and for applications filed by companies, "Legal Entity".

What are a collective trademark, a guarantee trademark and a jointly owned trademark?

A collective trademark is a type of trademark under which two or more businesses cooperate to market their products or services under a specific sign. Several companies can register a collective trademark by agreeing on the conditions and manner in which the trademark will be used.

A guarantee trademark is used to assure consumers about the quality, production method, geographical origin or other characteristics of a product or service. While a collective trademark is created jointly by companies, a guarantee trademark signifies a certain level of quality.

A jointly owned trademark is a trademark for which more than one natural and/or legal person files a single trademark registration application.
