1. Scope
1.1. These Trademark Services Special Terms (the “Special Terms”) apply, to the extent of the service purchased by the CUSTOMER, to the trademark availability search, trademark registration application, registration and registration certificate procedures, appeals against TÜRKPATENT decisions, oppositions to applications published in the Official Trademark Bulletin, submission of observations or defenses against oppositions, trademark renewal, assignment and partial assignment, address, trade name or legal form changes, license recordal procedures and other trademark services offered by METUnic.
1.2. These Special Terms form a supplementary part of the METUnic Product and Service Agreement. Matters not regulated under these Special Terms shall be governed by the provisions of the Product and Service Agreement.
1.3. Trademark procedures are subject to Industrial Property Law No. 6769, the relevant legislation, and the applicable rules, procedures and practices of the Turkish Patent and Trademark Office (“TÜRKPATENT”). Unless expressly agreed otherwise by METUnic, these Special Terms cover trademark procedures carried out before TÜRKPATENT.
2. Availability Search and Trademark Application
2.1. The CUSTOMER is required to provide the trademark representation, applicant information, scope of goods and services, and any other information, documents and authorizations required for the trademark procedure in a complete, accurate and up-to-date manner.
2.2. A trademark availability search constitutes a preliminary assessment based on accessible records and applications before filing. A positive search result does not guarantee that the relevant trademark will be registered by TÜRKPATENT or that it will not be subject to opposition by third parties.
2.3. The subject matter of the trademark application is determined based on the word, expression, logo, device, slogan or other trademark elements selected by the CUSTOMER and the goods and services to be covered by the application.
2.4. The scope of trademark protection is determined according to the goods and services specified in the application and the classes in which they are included. The CUSTOMER is required to provide accurate and sufficient information regarding the goods and services for which protection is requested in view of its current and planned activities.
2.5. The application shall be filed with TÜRKPATENT after the necessary information and documents have been provided, the required approvals have been obtained and the relevant fees have been paid.
3. Power of Attorney and Conduct of Proceedings
3.1. Trademark procedures required to be carried out before TÜRKPATENT may, depending on the nature of the procedure, be carried out through a trademark attorney authorized by METUnic.
3.2. Where required for the relevant procedure, the CUSTOMER is required to provide the power of attorney and other information and documents within the applicable period.
3.3. METUnic shall not be liable, except to the extent attributable to its own fault, for any failure to complete a procedure, delay, or missed statutory deadline resulting from the CUSTOMER’s failure to provide the required information, documents, approvals or payments in a timely manner.
4. Examination, Publication and Opposition Proceedings
4.1. Trademark applications are examined by TÜRKPATENT in accordance with the relevant legislation. As a result of the examination, the application may be accepted or refused in whole or in part, or completion of missing information or documents may be requested.
4.2. Trademark applications that pass the relevant examination stages may be published in the Official Trademark Bulletin and may be subject to opposition by third parties in accordance with the relevant legislation.
4.3. Appeals against TÜRKPATENT decisions, oppositions to publication, submission of observations or defenses against oppositions and similar post-application procedures shall be carried out by METUnic where included within the service purchased by the CUSTOMER or purchased separately.
4.4. For procedures subject to deadlines, the CUSTOMER is required to provide the requested information, documents and approvals and make the required payments within the notified period.
4.5. Unless expressly undertaken otherwise by METUnic, responsibility for monitoring and tracking trademark rights rests with the CUSTOMER.
5. Registration, Term of Protection and Renewal
5.1. Once the registration requirements have been completed and the required fees have been paid, the trademark shall be registered by TÜRKPATENT.
5.2. The term of protection of a registered trademark is 10 (ten) years and may be renewed for successive periods of ten years in accordance with the relevant legislation.
5.3. In order for a trademark renewal to be carried out, the CUSTOMER must submit the renewal request within the period prescribed by the relevant legislation, provide the required information and documents, and pay the applicable fees.
5.4. If the renewal procedure is not completed within the applicable periods, the trademark right may expire. Renewal periods and any possibility of late renewal shall be subject to applicable legislation and TÜRKPATENT practices.
6. Assignment, License and Registry Changes
6.1. Trademark assignment and partial assignment, license recordal and renewal, address change, company trade name or legal form change and similar registry procedures shall be carried out within the scope of the service separately requested by the CUSTOMER.
6.2. In order for such procedures to be carried out, the CUSTOMER is required to provide the information, documents, agreements, authorizations and fees required under applicable legislation and TÜRKPATENT practices.
6.3. The recordal and outcome of assignment, license or other registry procedures before TÜRKPATENT are subject to applicable legislation and the assessment of the TÜRKPATENT.
7. Fees, Cancellation and Refund
7.1. The METUnic service fee relating to trademark procedures and any official fees collected by TÜRKPATENT shall be communicated to the CUSTOMER before the relevant procedure.
7.2. If official fees are changed by TÜRKPATENT before the relevant procedure is carried out, the fees in effect on the date of the procedure shall apply and any fee difference may be charged to the CUSTOMER.
7.3. Once an application has been filed with TÜRKPATENT or the relevant procedure has been completed, the corresponding Service may not be cancelled or refunded to the extent that the transaction cannot be reversed. Refunds of official fees paid to TÜRKPATENT shall be subject to the rules applicable to the relevant procedure.
7.4. Rejection of a trademark application in whole or in part, opposition by a third party, or failure of the application to result in registration shall not, in itself, give rise to a right to a refund for services already performed. The CUSTOMER’s rights arising from mandatory consumer legislation are reserved.
8. Responsibilities of the CUSTOMER
8.1. The CUSTOMER is responsible for ensuring that signs, logos, images, trade names and other elements that are the subject of an application or other trademark procedure do not infringe third-party rights and that the CUSTOMER has the necessary rights or authority for such elements to be the subject of the application.
8.2. The CUSTOMER is responsible for the accuracy and currency of information and documents relating to the trademark owner and the scope of the procedure, and for notifying METUnic in a timely manner of any changes to such information that must be reflected in the relevant register.
8.3. The CUSTOMER is required to provide the information, documents, approvals and payments requested by METUnic in a timely manner for trademark procedures subject to deadlines.
9. Limitations Regarding Outcome
9.1. METUnic shall not be liable, except to the extent attributable to its own fault, for the outcomes of examinations or decisions by TÜRKPATENT, third-party oppositions, decisions of judicial authorities, or other official proceedings outside METUnic’s control.
9.2. Registration of a trademark does not constitute a guarantee that every use of the trademark is lawful or that no dispute will arise with third parties.
10. Language
10.1. In the event of any discrepancy or inconsistency between the Turkish and English versions of these Special Terms, the Turkish version shall prevail.
