I)Definition and Scope of the Service
- The Backorder service is a preliminary request and application service. Under this service, the CUSTOMER’s advance request is recorded for a domain name that is not yet released or is currently unavailable for registration, in anticipation of the possibility that such domain name may become available in the future. When the domain name becomes eligible for registration, an attempt to register the domain name on behalf of the request holder shall be made.
- The Backorder service does not provide any guarantee or priority right that the domain name will be registered in the name of the CUSTOMER; it merely constitutes a preliminary record enabling an attempt to register the domain name for the request holder when the domain name becomes eligible for registration.
- This service does not mean or imply that the domain name will be registered in the name of the requesting CUSTOMER.
- The CUSTOMER acknowledges and agrees that the Backorder service and domain name registration processes are subject to the rules, technical procedures, timing, third-party processes, and other factors determined by the relevant registry authorities and beyond the control of METUnic.
- METUnic makes no representations, warranties, or guarantees with respect to the following:
- that the domain name will be released;
- that the domain name will be successfully registered in the name of the CUSTOMER;
- that third parties or registry authorities will not be involved in the process.
- The service does not constitute a reservation, priority right, or definitive registration of the domain name.
- The Backorder service is provided by METUnic upon the CUSTOMER’s request and is linked to a specific domain name.
- In order for METUnic to provide the Backorder service, the CUSTOMER is deemed to have accepted these Backorder Service Terms and Conditions.
- While benefiting from the service, the CUSTOMER accepts, declares, and undertakes to comply with these Terms and Conditions as well as all policies and procedures published at www.metunic.com.tr.
- By purchasing the Backorder service for a domain name, the CUSTOMER accepts, declares, and undertakes to be bound by these Terms and Conditions.
- These Terms and Conditions constitute an integral annex to the Product Service Agreement executed between METUnic and the CUSTOMER and shall have full legal force and effect together with such agreement.
II)Submission of Requests and Preliminary Registration Process
- The CUSTOMER submits the Backorder request through the methods and platforms designated by METUnic.
- Multiple Backorder requests for the same domain name shall not be accepted. The request of the first CUSTOMER shall be deemed valid.
- The receipt of the request or its visibility in the CUSTOMER’s panel or system does not mean that the domain name has been successfully registered.
III)Pricing and Payment Terms
- In order for a Backorder request to be accepted, the Backorder service fee determined by METUnic and the applicable domain name registration fee must be paid by the CUSTOMER in advance.
- A request shall be deemed validly created only upon the full and successful payment by the CUSTOMER of all fees arising from the Backorder request. Requests submitted without completion of payment or with unsuccessful payment transactions shall not be deemed Backorder requests and shall not create any obligation on the part of METUnic.
- Although the Backorder service constitutes a preliminary request, the CUSTOMER may cancel the request only prior to METUnic initiating the registration attempt, using the method determined by METUnic. Cancellation requests submitted after the initiation of the registration attempt shall not give rise to any right to a refund.
- In the event that the domain name cannot be successfully registered in the name of the CUSTOMER for any reason, the full amount collected in relation to such request shall be refunded to the CUSTOMER without any deduction.
- If the domain name is successfully registered by METUnic in the name of the CUSTOMER, the registration shall be deemed completed and the collected fees shall under no circumstances be refunded. The CUSTOMER’s decision not to use the domain name, to discontinue the registration, or to abandon further registration procedures after registration shall not alter this result, and no refund shall be made.
IV)Miscellaneous Provisions
- METUnic undertakes to use all reasonable resources necessary to provide the Backorder service with reasonable continuity. The CUSTOMER acknowledges that access to the service may be interrupted due to force majeure events, system failures, scheduled maintenance, telecommunications outages, malicious attacks, heavy traffic, or other circumstances beyond METUnic’s control. METUnic shall not be held liable even if such interruptions affect the outcome of the service.
- METUnic may disclose service-related records solely to the relevant authorities in response to lawful requests from competent public authorities (e.g., BTK, TRABİS, courts). Depending on such official requests, the service may be suspended, the request may not be processed, or it may be cancelled. The CUSTOMER shall not hold METUnic liable for any damages arising therefrom.
- The CUSTOMER is solely responsible for the security of the user account through which access to the Backorder service is provided. METUnic shall not be liable for any consequences arising from the sharing of account information with third parties, password security breaches, or unauthorized access.
- Due to the dynamic nature of internet and registry authority processes, METUnic may update the Backorder service terms from time to time. METUnic shall notify the CUSTOMER of such changes within a reasonable period. Continued use of the service by the CUSTOMER shall constitute acceptance of such changes.
- The CUSTOMER accepts and undertakes to use the Backorder service solely within lawful, reasonable, and permitted usage limits and not to engage in any use that may adversely affect the operation, security, or METUnic’s infrastructure. METUnic reserves the right to refuse, restrict, or terminate Backorder requests in any situation it deems to constitute abuse or non-standard use.
- In order to protect the security, continuity, and fair use of the service for other users, METUnic reserves the right to limit, reject, cancel Backorder requests, suspend the service, or terminate it entirely in cases of excessive, abnormal, or abusive use. The CUSTOMER shall be responsible for compensating METUnic for any direct or indirect damages incurred as a result of such conduct.
- In order to prevent abuse through system overload, avoid potential loss of rights for other CUSTOMERS, and prevent unnecessary congestion over domain names, METUnic reserves the right to take all measures it deems necessary, including but not limited to refusing to accept Backorder requests, and to apply relevant sanctions.
