1. Scope
1.1. These Domain Name Services Special Terms (the “Special Terms”) apply to the domain name application, allocation, renewal, transfer and domain name management transactions and services offered by METUnic.
1.2. These Special Terms form a supplementary part of the METUnic Product and Service Agreement. Matters not regulated under these Special Terms shall be governed by the provisions of the Product and Service Agreement.
1.3. Domain name transactions are subject, depending on the domain extension, to the applicable rules, policies and procedures of ICANN, TRABIS, the relevant registry authority and other competent organizations.
2. Domain Name Application and Allocation
2.1. During the domain name application process and throughout the period in which the domain name remains allocated, the CUSTOMER is responsible for ensuring that the registration and contact information relating to the domain name is accurate, current and complete. Where necessary, METUnic, the relevant registry authority or competent organization may request additional information, documents, verification or updates. The CUSTOMER is required to complete the requested actions within the applicable periods. If the information cannot be verified or is incomplete or outdated, METUnic reserves the right to take the necessary actions and measures in accordance with applicable law and the rules of the relevant registry authority.
2.2. The fact that a domain name appears to be available at the time of a search does not mean that the domain name will be allocated to the CUSTOMER. Allocation occurs when the transaction is successfully completed in the relevant registration system.
2.3. Domain name allocation may, depending on the nature of the extension, be subject to the “first come, first served” principle, documentation or eligibility requirements, and the rules of the relevant registry authority.
2.3.1. Allocation and related transactions for .tr domain names are carried out within the framework of TRABIS regulations. Where documentation or eligibility requirements apply to an extension, the relevant requirements must be satisfied.
2.4. The CUSTOMER is responsible for the selection of the domain name applied for and for ensuring that such domain name does not infringe any trademark, trade name, intellectual and industrial property right or other right of a third party.
2.5. Registration data relating to a domain name may be collected, processed, transferred to the relevant organizations and made accessible through registration data lookup systems in accordance with the applicable ICANN, TRABIS and registry authority rules for the relevant domain extension.
3. Allocation Period and Renewal
3.1. The allocation period of a domain name is determined by the period selected by the CUSTOMER at the time of purchase and the rules applicable to the relevant domain extension.
3.2. In order to continue using the domain name, the CUSTOMER is required to complete the renewal procedures within the applicable period and pay the relevant fee.
3.3. METUnic may send notifications regarding domain names eligible for renewal through the communication channels registered in the CUSTOMER’s panel. METUnic shall not be responsible for the failure of such notifications to reach the CUSTOMER due to outdated contact information.
3.4. If a domain name is not renewed within the applicable period, late renewal or redemption/recovery may be available depending on the relevant domain extension and the rules of the registry authority. Such transactions may be subject to late renewal, redemption or recovery fees in addition to the standard renewal fee.
3.5. If no action is taken within the applicable renewal or redemption/recovery period, the allocation right over the domain name may terminate and the domain name may become available for allocation again. After this stage, there is no guarantee that the domain name can be reallocated to the CUSTOMER.
4. Domain Name Transfer and Transfers Between Accounts
4.1. Transfers of domain names to METUnic or from METUnic to another registrar are carried out in accordance with the legislation applicable to the relevant extension, ICANN policies, TRABIS rules and the requirements of the relevant registry authorities.
4.2. The CUSTOMER is responsible for satisfying the requirements necessary to carry out a transfer, including removal of the transfer lock, obtaining the authorization/transfer code, completing the required verifications and fulfilling any other applicable technical or administrative requirements.
4.3. Under the rules of the relevant registry authority, certain domain name extensions may be subject to a transfer restriction of 60 (sixty) days following allocation or transfer.
4.4. Transfers of domain names between METUnic accounts (“Internal Transfer”) are initiated by the sending account through the METUnic user panel and completed upon approval by the receiving account.
5. Change of Registrant, Assignment and Waiver
5.1. A change of registrant, assignment, sale or waiver of a domain name is subject to the applicable law and registry authority rules for the relevant domain extension.
5.2. The CUSTOMER is required to provide the information, documents, approvals and authorizations necessary for such transactions. METUnic may decline to carry out the transaction if the applicable requirements are not satisfied.
5.3. With respect to .tr domain names, assignment, sale, waiver and reallocation procedures shall be governed by the applicable procedures and principles established by TRABIS.
6. Fees, Cancellation and Refund
6.1. Fees relating to domain name allocation, renewal, transfer, redemption and other transactions shall be presented to the CUSTOMER before the relevant transaction.
6.2. Once successfully completed, domain name allocation, renewal or transfer transactions may not be cancelled or refunded to the extent that such transactions cannot be reversed. Mandatory provisions of consumer legislation relating to withdrawal and refunds shall apply to consumer transactions.
6.3. Where a transaction is carried out based on a domain name entered incorrectly or with a typographical error by the CUSTOMER, cancellation or refund shall be subject to the transaction and refund rules of the relevant registry operator or competent authority.
6.4. If a domain name transaction cannot be completed, whether the amount collected will be refunded or credited to the CUSTOMER’s account shall be determined based on the nature of the transaction, the practice of the relevant registry authority and the METUnic Cancellation and Refunding Policy.
7. Domain Name Disputes
7.1. In disputes relating to a domain name with third parties, the applicable legislation, dispute resolution policy and decisions of competent authorities for the relevant extension shall apply.
7.2. For disputes relating to .tr domain names, the TRABIS Dispute Resolution Mechanism and judicial remedies shall apply within the scope of the relevant legislation; for applicable gTLD domain names, ICANN dispute resolution policies shall apply. The TRABIS Dispute Resolution Mechanism is an alternative dispute resolution mechanism and does not prevent recourse to judicial authorities.
7.3. Upon a decision or request of a court, competent administrative authority, dispute resolution service provider, ICANN, TRABIS or the relevant registry authority, METUnic may freeze or suspend the domain name, restrict its transfer, make changes to its records or carry out any other action required by the relevant decision.
8. Suspension and Cancellation of the Domain Name
8.1. A domain name may be suspended, frozen or cancelled if the information provided by the CUSTOMER is found to be false or invalid, the relevant allocation conditions cease to be met, a competent authority or dispute resolution decision requires such action, abuse is detected, or in other circumstances stipulated by the relevant registry authority.
8.2. METUnic may apply the necessary technical and administrative measures in relation to the domain name where action is required under applicable law or the rules of the relevant registry authority.
9. Other Services Linked to the Domain Name
9.1. Expiration, suspension, cancellation or transfer of a domain name may affect the operation of websites, e-mail, DNS, forwarding, SSL or other services linked to that domain name. METUnic shall not be held liable where such impact results from an act or omission of the CUSTOMER, or from actions of the relevant registry authority or a third party.
10. Language
10.1. In the event of any discrepancy or inconsistency between the Turkish and English versions of these Special Terms, the Turkish version shall prevail.
