1.3. In the event of any discrepancy between the Product and Service Agreement and these Terms of Use concerning the Hosting Service, these Terms of Use shall prevail with respect to the relevant service.
2. Definitions

Infrastructure Provider: Providers of data center, server, network, software, licensing, control panel, security, backup or similar technical services used in providing the Service.
3. Scope of the Service
3.1. Unless otherwise specified, the Service is provided through shared infrastructure for the purpose of hosting the website and Content hosted under accounts belonging to or created by the Customer, within the scope of the selected package, and does not grant the Customer the exclusive right to use any particular server. The number of accounts, resources and other technical specifications are stated in the relevant package description or order summary. For features offered as unlimited or without limits under the package, numerical values displayed in technical systems shall not constitute an additional usage limit.
3.2. Domain names, SSL certificates, dedicated IP addresses, backup, website migration, licensing, security, malware removal, software installation and similar services are not included in the Service unless expressly stated as included in the package.
3.3. Issues arising from the Customer’s domain name, DNS, devices, software, applications or third-party services shall not be considered within the scope of the Hosting Service.
4. Third-Party Infrastructure and Sub-Service Providers
The Service Provider may use third-party infrastructure and support service providers in delivering the Service. Provided that the nature of the Service is not materially adversely affected, the Service Provider may make technical or operational changes, take into account the applicable rules of the relevant infrastructure providers concerning the security and resource management of the Service, and implement the necessary technical and operational measures in this context.
5. Account, Software and Application Security
5.1. The Customer is responsible for ensuring that the information and documents provided during ordering and use of the Service are accurate, complete, up to date and truthful, and for maintaining the confidentiality and security of access credentials relating to the Service.
5.2. The Service Provider may request additional information or documents from the Customer for purposes of security, payment, legal compliance, investigation of misuse or verification of account ownership.
5.3. The Customer is responsible for the licensing compliance, currency and security of the software, applications, themes, plugins, scripts, databases and other components used; for applying necessary security updates; and for removing unused accounts, software and access permissions.
5.4. Where a security risk is identified, the Service Provider may implement necessary technical and operational measures concerning the relevant files, processes, access, email accounts or Hosting Service to eliminate the risk or limit its effects.
6. Content and Lawful Use
6.1. The Customer is responsible for all Content hosted, published, processed or made accessible within the scope of the Service and is the content provider for such Content under Law No. 5651.
6.2. The Customer shall use the Service in compliance with the laws of the Republic of Türkiye, third-party rights, the METUnic Product and Service Agreement, these Terms of Use and principles of fair use.
6.3. The Customer acknowledges that it holds the necessary rights to use, process, reproduce, publish and host the Content and that the Content does not infringe third parties’ intellectual and industrial property rights, personality rights, commercial reputation, privacy or rights relating to the protection of personal data.
6.4. Without limitation to the activities listed in this clause, the Service may not be used for:
- Unlawful content and activities;
- Spam, phishing and fraud;
- Malware and security breaches;
- Unauthorized access and attack activities;
- Activities that harm the infrastructure or third parties;
- Uses outside the intended purpose of the package or involving excessive consumption of resources;
- Use as a file backup, archiving, bulk file storage, file sharing or cloud storage space, other than for hosting websites and related content.
6.5. The Customer shall ensure that persons to whom it grants access to the hosting account and, where applicable, its own users, use the account in accordance with the law and these Terms. If the Customer becomes aware of unlawful or unauthorized use, it shall take reasonable and necessary measures to stop the violation and limit its effects.
7. Resource Usage and Email Services
7.1. The Customer shall use the resources allocated to it in accordance with the technical specifications of the selected package, the ordinary purpose of the Service and the fair use principles applicable to shared hosting services. Technical resources and usage limits are subject to the conditions specified in the selected package description or order summary. High numerical values configured due to software, control panel or API requirements for features offered as unlimited or without limits under the package shall not be regarded as contractual usage limits.
7.2. If the Customer’s resource usage adversely affects other customers, system security, performance or service continuity, the Service Provider may request a reduction in usage or temporarily restrict the relevant resources.
7.3. Where the package includes email service, the account, storage and sending limits specified in the relevant package description shall apply. The email service may not be used for spam, unsolicited commercial electronic communications, phishing, malware distribution or unlawful bulk messaging. In the event of a security risk or misuse, the relevant email account or sending authorization may be restricted or suspended.
8. Support Requests
8.1. Standard technical support is limited to access to the hosting account and investigation of infrastructure-related issues. Website, software, device, third-party application, website migration, malware removal and similar operations are not covered by support unless separately provided.
8.2. Operations outside the scope of standard support may be subject to additional charges. Support requests shall be submitted through the communication channels designated by the Service Provider.
9. Backup and Data Responsibility
The Customer shall maintain up-to-date backups of its data independently of the Service infrastructure. The provision of a backup service does not relieve the Customer of this obligation. Backup and restoration conditions are set out in the relevant package or additional service description; restoration operations may be subject to additional charges and may affect existing data. The Service Provider’s liability for its own fault and the provisions of mandatory law are reserved.
10. Personal Data and Records
10.1. The Parties shall comply with applicable personal data protection legislation in their personal data processing activities within the scope of the Service.
10.2. The Customer is responsible for the lawfulness of personal data processed through its website, applications and Content, for providing the necessary privacy notices and implementing security measures, and for fulfilling applicable recordkeeping obligations.
10.3. The Service Provider may process necessary personal data and traffic, access, transaction, security and system logs for purposes of providing and securing the Service, technical support, backup where applicable, preventing misuse and fulfilling legal obligations. Such processing may also be carried out through infrastructure providers.
11. Misuse, Intervention and Termination
11.1. If a notification is received concerning the Customer’s Content or use of the hosting account, or if a violation, misuse, technical risk or security risk is identified, the Service Provider may request an explanation, information or documents from the Customer or require the violation to be remedied.
11.2. Where possible and appropriate, the Service Provider may grant the Customer a reasonable period to remedy the violation. In cases involving a request by a competent authority, ongoing fraud, malware, cyberattacks, large-scale spam or similar circumstances requiring urgent action, it may implement necessary technical and administrative measures without prior notice.
11.3. Depending on the nature and severity of the violation, the relevant Content, operation, access or resource usage may be restricted, and the Service may be suspended in whole or in part. The Service may be terminated in cases of serious, ongoing or repeated violations or where there is a serious risk to security or third-party rights.
11.4. Suspension or termination of the Service shall not release the Customer from payment and other obligations already accrued.
11.5. If the Service Provider incurs direct and documented losses or is held legally liable to third parties or infrastructure providers as a result of the Customer’s breach of these Terms of Use, the Service Provider reserves the right to recover such losses and reasonable expenses from the Customer, without prejudice to the Service Provider’s own fault.
12. Service Continuity and Maintenance
12.1. The Service Provider shall take reasonable technical and operational measures to ensure continuity of the Service. Uninterrupted or error-free operation of the Service is not guaranteed; no particular availability percentage or service level is committed to unless separately stated in the relevant package, offer or service level terms.
12.2. Temporary interruptions or slowdowns may occur due to scheduled maintenance, updates, infrastructure work or emergency security interventions. Scheduled work shall be announced to the extent possible.
12.3. Issues arising from the Customer’s systems and applications, third-party services not attributable to the Service Provider, internet and data center infrastructure, cyberattacks, actions of public authorities or other circumstances beyond the Service Provider’s reasonable control shall not constitute service level violations. The provisions of the Product and Service Agreement shall apply in cases of force majeure.
13. Package Changes
The Customer may request a change between packages offered by the Service Provider. Package changes shall be made in accordance with the technical conditions and pricing principles applicable to the relevant packages. In the event of a downgrade, the Customer shall ensure that its existing usage complies with the limits of the new package.
14. Fees, Renewal and Non-Payment
The Service fee shall be collected in advance. Unless otherwise specified, renewal shall be at the current price applicable on the renewal date. If payment is not made on time, the Service may be suspended; the account and data may be deleted after the period specified in the applicable terms. The Customer shall back up its data before the Service terminates.
15. Cancellation, Withdrawal and Refunds

15.3. For cancellation requests submitted after the 15-day period following purchase of the Service, no refund shall be made, without prejudice to the provisions of mandatory law.
15.4. Domain names, SSL certificates, licenses, dedicated IP addresses, additional resources, services specifically procured or performed for the Customer, and non-refundable third-party costs are excluded from refunds unless otherwise specified in the relevant service or order terms.
15.5. Where the Service is suspended or terminated for cause due to the Customer’s use in breach of the agreement or the law, no refund shall be made, without prejudice to the provisions of mandatory law.
16. Liability
16.1. The Service Provider shall be liable only for proven losses directly caused by its own fault, in accordance with the provisions of mandatory law.
16.2. The Customer is responsible for liability arising from its Content, software, account security, user activities, licenses, personal data processing activities and unlawful use of the Service. Cases involving willful misconduct or gross negligence by the Service Provider, and circumstances in which liability cannot be limited, are reserved.
16.3. The Service Provider’s total liability under these Terms of Use shall be limited to the total Service fees actually paid by the Customer for the relevant Service during the preceding 12 months, without prejudice to the provisions of mandatory law and cases of willful misconduct or gross negligence.
17. Amendments, Notices and Entry into Force
17.1. The Service Provider may amend these Terms of Use due to legal, security, infrastructure or service requirements. Material amendments shall be announced to the Customer before taking effect through the website, customer panel, email or other appropriate channels.
17.2. The Customer shall ensure that the contact information provided to the Service Provider is accurate and up to date. Notices sent to registered communication channels shall be deemed valid.
17.3. These Terms of Use shall enter into force upon approval of the Product and Service Agreement and placement of the Hosting Service order.
